These Terms govern use of the Xenifit website, Glute Academy platform and related materials and services.

1. Acceptance
By purchasing access, creating an account or using Glute Academy, you confirm that you have read and agree to comply with these Terms. If you do not agree, do not purchase or use access.
2. Age
Glute Academy is intended only for users aged 18 and over.
3. What Glute Academy is
Glute Academy is a digital fitness and educational platform that may include workout programs, exercise videos, Academy materials, information about training, nutrition, cardio, recovery and related topics, workout and progress tracking tools, and support features.
Unless otherwise stated on the purchase page, a purchase provides 60 days of access. The current purchase does not renew automatically unless automatic renewal is expressly disclosed before payment.
4. Account
An account is intended for one individual user only. You are responsible for keeping your login information secure and for activity carried out through your account. Sharing an account, allowing multiple people to use one account, or systematically providing third parties with access to Glute Academy is prohibited.
5. Personal licence to materials
A purchase grants a limited, personal, non-exclusive and non-transferable right to use Glute Academy materials during the paid access period.
Without Xenifit's permission, materials may not be:
- resold;
- published;
- distributed to third parties;
- uploaded to public repositories or groups;
- systematically copied;
- used to create a competing product;
- made available to other people through your account.
All rights in original workout, educational, video, text and graphic materials remain with their respective rights holders.
6. Suspension and termination
Xenifit may temporarily restrict access while investigating suspicious activity.
Where there are reasonable and supported grounds to conclude that a user has materially violated these Terms, for example by sharing an account with third parties, systematically distributing materials, reselling content or otherwise using the platform without authorization, access may be terminated.
Where access is terminated because of a material violation of these Terms, a refund for the remaining access period is generally not provided, except where required by applicable law.

7. Fitness and health
Glute Academy provides fitness and educational information and is not a medical service.
Platform materials do not replace diagnosis, treatment or individualized advice from a physician or other qualified healthcare professional.
Users are responsible for assessing their ability to exercise safely and should stop an exercise if unusual pain, significant discomfort or other concerning symptoms occur.
Where a medical condition, injury, pregnancy or another circumstance may affect exercise safety, the user should seek appropriate individual professional advice where necessary.
8. Nutrition information
Nutrition materials are provided for educational purposes and do not constitute medical diagnosis, treatment or an individualized therapeutic diet.
Glute Academy does not promise a universal ready-made meal plan unless expressly stated in the description of a specific product.
9. Results
Training results depend on many individual factors, including consistency, intensity, nutrition, recovery, starting condition and individual characteristics.
Xenifit does not guarantee a specific change in body weight, appearance, muscle mass, strength or any other individual outcome.
10. User data and materials
Users retain rights in their own photos, videos and other information uploaded to the platform.
Users grant Xenifit only the limited right to technically store, process and display those materials to the extent necessary to provide the relevant functionality and service.
This permission does not itself authorize Xenifit to use progress photos or other personal materials in advertising or public communications. Separate permission is required for such use.
11. Payment
Payment may be processed through third-party payment services, including Stripe and Lava.top.
Access is provided based on confirmation of successful payment and the existing activation system.
Where automatic access requires the same email address used at payment to be used for the account, the user is responsible for following that instruction displayed on the purchase page.
12. Refunds
Refunds are governed by the separate Refund Policy, which forms part of these Terms.
Nothing in these documents limits mandatory consumer rights that cannot legally be waived.
13. Platform operation
We aim to provide stable access to Glute Academy, but cannot guarantee uninterrupted availability without technical interruptions.
Updates, fixes and maintenance may occur.
Platform content, design and functionality may develop and change over time. Such changes are not intended to arbitrarily deprive a user of the core access already purchased.
14. Third-party services
Some features may use or link to third-party services, such as payment systems, Telegram or external video services.
Use of those services may also be governed by their own terms and privacy policies.
15. Limitation of liability
To the maximum extent permitted by law, Xenifit is not liable for indirect or consequential losses resulting from misuse of materials, ignoring contraindications, exercising despite pain or medical restrictions, or circumstances outside Xenifit's reasonable control.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
16. Governing law
These Terms are governed by the laws of Ontario and the applicable laws of Canada, subject to any mandatory consumer rights that apply to a user and cannot legally be restricted by contract.
